Inventions can be protected in the form of a patent using one of these two filing procedures:
1/ Under the PCT Agreement (Patent Cooperation Treaty (PCT)) which allows you to protect your inventions in designated territories, including China, within the framework of an international procedure.
2/ Via a national filing with the Chinese intellectual property office. There are 3 types of patents:
- Invention Patents: protection for up to 20 years.
- Utility Model Patents: protection for up to 10 years.
- Design patents: protection for up to 10 years.
